About SwimFitz
SwimFitz is a home coaching platform operated by Brian FitzGerald. We connect you with self-employed Associate Teachers and Coaches (together, “Coaches”) who deliver private one-to-one sessions at your home or another location you provide.
SwimFitz arranges sessions across a range of activities, which currently include swimming, tennis, padel, cricket, basketball, gymnastics, ballet, barre, Pilates, yoga, personal training and running. The activity you have booked is referred to in these Terms as the “Activity”, and each booked appointment as a “Session”. Not every Activity is available in every area.
All bookings and payments are handled by SwimFitz. By making a booking with SwimFitz, you agree to these Terms in full.
1. Booking
1.1 All bookings are made through SwimFitz via our website or direct communication.
1.2 A booking is confirmed once payment is received in full.
1.3 Your Session will be delivered by a Coach allocated by SwimFitz who holds qualifications appropriate to the Activity.
1.4 SwimFitz reserves the right to allocate a different Coach if your original Coach is unavailable, subject to comparable qualifications for the Activity.
1.5 Session length, format and content vary by Activity and are agreed with you at the time of booking.
2. Pricing
2.1 Fees vary by Activity, Session length and location, and are as agreed in writing at the time of booking.
2.2 Unless we tell you otherwise in writing, the agreed fee includes the Coach's travel to your location. Where a location is outside a Coach's usual area, any travel contribution will be agreed with you in advance.
2.3 Fees are reviewed periodically — your agreed rate applies for your current booking.
3. Payment
3.1 Payment is due in full at the time of booking.
3.2 All payments are made directly to SwimFitz. Do not pay any teacher directly — your payment is not protected if made outside of SwimFitz.
3.3 Accepted payment methods: bank transfer, card via Stripe link.
3.4 Receipts are issued via email upon payment.
3.5 Ongoing Sessions may be billed by emailed invoice, payable by bank transfer or card.
4. Cancellations & Refunds
4.1 48 or more hours' notice: full refund or free rescheduling.
4.2 24–48 hours' notice: 50% refund.
4.3 Less than 24 hours' notice: no refund.
4.4 If SwimFitz cancels, you will receive a full refund or be offered a replacement Session at no extra cost. SwimFitz is not liable for cancellations caused by circumstances beyond our control (for example severe weather, illness, or loss of access to the location).
5. Health, Safety & Your Location
5.1 You are responsible for providing a location that is safe, clean, adequately sized and otherwise suitable for the Activity, and for ensuring it remains so throughout the Session. Depending on the Activity this may include a pool, court, garden, driveway, studio or indoor room, together with safe access to it.
5.2 You are responsible for disclosing anything about the location that could affect safety — including water depth and pool plant, floor and ground surfaces, low ceilings, glass, obstructions, lighting, pets and any recent works — before the first Session and whenever it changes.
5.3 Equipment. What equipment a Coach brings varies by Activity, by Coach and by Session, and is a matter for agreement in advance. Unless we have specifically agreed otherwise with you in writing, you should not assume that any particular equipment, apparatus, matting, safety equipment or protective surface will be provided. Where equipment, apparatus or facilities are provided by you or are already present at the location, you remain responsible for their condition, suitability, maintenance and safe working order, and SwimFitz is not responsible for them.
5.4 Please tell us about any medical condition, injury, disability, allergy, pregnancy or other health matter relevant to the Activity before the first Session, and keep us updated if anything changes.
5.5 For physically demanding Activities — including personal training, running, Pilates, yoga, barre, gymnastics and racket sports — you confirm that the participant is in good health and fit to take part, and that you have taken medical advice where there is any doubt. Participants take part at their own risk in this respect and should stop and seek advice if they feel unwell.
5.6 We require every Coach to hold, and to keep current, an Enhanced DBS certificate, their own public liability insurance and qualifications appropriate to the Activity they deliver, and to provide evidence of these to us on request. Coaches are self-employed and are responsible for maintaining their own credentials and insurance cover.
5.7 Sessions involving anyone under 18 must have a parent or guardian present on the premises at all times.
5.8 A Coach may pause, shorten, relocate or end a Session at any time if, in their reasonable judgement, conditions are not safe for the Activity. Where a Session is ended early for this reason, no refund is automatically due.
5.9 Subject to section 13, SwimFitz and its Coaches accept no liability for injury, loss or damage arising from unsafe or unsuitable conditions, or from equipment or facilities, that were not disclosed to us before the Session.
6. Safeguarding
6.1 SwimFitz takes safeguarding seriously. We require every Coach to hold a current Enhanced DBS certificate and to evidence it to us, and we record renewal dates.

7. Your Coach
7.1 SwimFitz introduces you to a Coach to deliver your Sessions. Your Coach is self-employed and contracted to SwimFitz, and is not an employee of SwimFitz.
7.2 All contractual and payment obligations remain with SwimFitz — not with the individual Coach.
7.3 Please do not arrange Sessions directly with your SwimFitz Coach, or pay them outside of this platform. Doing so falls outside our safeguarding and insurance framework, and SwimFitz accepts no responsibility for any arrangement made that way.
8. Attendance & Behaviour
8.1 The participant must be ready at the agreed start time. Time lost to a late start is not made up or refunded.
8.2 A responsible adult must remain on site for all participants under 16.
8.3 Disruptive, abusive or unsafe behaviour may result in a Session or booking being ended immediately without refund.
9. Weather & Venue Availability
9.1 Sessions may be rescheduled where weather or ground conditions make an outdoor Activity unsafe — including outdoor pools, courts and gardens. SwimFitz will notify you promptly.
9.2 If your pool, court or other space becomes unavailable — through maintenance, works, repairs or any other cause — it is your responsibility to tell us in advance. Refunds are not automatically issued.
10. Photography & Media
10.1 No photography or video recording is permitted during Sessions without prior written consent from SwimFitz.
10.2 SwimFitz may occasionally photograph or film sessions for marketing purposes only with your prior written consent.
11. Data & Privacy
11.1 SwimFitz collects your name, contact details, and relevant health information to deliver your Sessions safely.
11.2 We share your details with your allocated Coach for the purpose of delivering your Session only. We do not sell or share your data with third parties.
11.3 All personal data is handled in accordance with UK GDPR. See our Privacy Policy for full details.
11.4 Ongoing clients are given a personal progress account at app.swimfitz.com to view progress, milestones and upcoming Sessions. Your data in the portal is handled per our Privacy Policy.
11.5 Your account is personal to you. Please keep your login private and do not share it. SwimFitz (Brian FitzGerald) is your point of contact for the account.
11.6 Coaches using the portal can see only the clients assigned to them and their progress — not your contact details.
12. Complaints
12.1 If you are unhappy with any aspect of your Session, please contact us within 48 hours via ask@swimfitz.com or WhatsApp.
12.2 We will respond within 2 business days and work to resolve any issue fairly.
13. Liability
13.1 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded. Your statutory rights as a consumer are not affected.
13.2 Subject to 13.1, SwimFitz is not liable for loss or damage that was not foreseeable, for loss arising from information you did not give us, or for any indirect or consequential loss.
13.3 Subject to 13.1, our total liability to you in connection with any booking is limited to the total fees you have paid to SwimFitz for the Sessions to which the claim relates.
13.4 Coaches are self-employed and carry their own public liability insurance. SwimFitz introduces and administers, and is not liable for the professional acts or omissions of a Coach beyond the limits set out in this section.
13.5 SwimFitz is not liable for damage to property, surfaces, flooring, equipment or fittings at your location arising from normal participation in the Activity.
13.6 Neither party is liable for failure to perform caused by events beyond its reasonable control.
14. Governing Law
These Terms are governed by the laws of England and Wales. By using SwimFitz services, you agree to these Terms in full.
